How do courts decide rights to pets in Florida divorce cases?
In Florida, pets are considered property. They are not considered like children where time sharing or custodial rights apply. In Florida, the pets will be divided just like the pots and pans, and the furniture. If you and your spouse would like to share the pets in a different way, then you and your spouse need to reach an agreement reduced to writing. Otherwise, the court will simply award the pet to one spouse to the exclusion of the other spouse.
