How do I know if I qualify for alimony?
Florida's alimony statute sets out the factors that the court must consider in awarding alimony. The basic premise is need and ability to pay. If you have a demonstrated need based on the factors contained in the statute, then the court goes to the second step, which is whether your spouse has the ability to pay alimony. Assuming there is both, the court should award alimony in your case.
