Is my spouse entitled to a portion of my business in Florida?

Pursuant to Florida law, a marital asset is any asset established during the marriage with marital effort or marital funds. Therefore, if you had a business that was established during the marriage, your spouse would be entitled to a portion of that business. If you had a business that was established prior to the marriage but existed during the marriage and during the marriage, marital efforts or marital funds were used to sustain that business, then your spouse would be entitled to a share of the marital value. The value that existed during the marriage for that business and there would be an equitable distribution of the business during the marriage.
